Collisions with uninsured drivers require you to protect yourself and those in your car that are injured.

The Iowa State Patrol reported about a two vehicle collision in Webster County on 160th Street and Quail Avenue. This is the same kind of crash as previously reported on involving a failure of the car to the left failing to yield the right-of-way. What makes it different is that Thoden did not have insurance along with failing to yield the right of way. Koch and her 4 year old passenger end up having to rely on Koch's own insurance policy for coverage. This can be a tricky situation. The driver often times believes their own insurance company will protect them, but that is not the case. When filing for coverage under the underinsured or uninsured motorist provisions of your own insurance policy you are at arms-length with your own insurance company. In other words they don't have any duty to treat you any better or worse than if you are filing with Thoden's insurance company; if she had insurance.

A word of caution is in order. Get yourself a lawyer when you have an uninsured or underinsurance claim. And do it right after the accident.
