If you are whining about the shoddy products coming in from China then stop you probably have no right to whine. In the past five years I've listened to more whining about trial lawyers then I needed to hear in my lifetime. So, here is a litmus test to determine if you have any right to whine about trial lawyers, lawsuits and lawyers in general. Take this test and if you answer yes to any of the first three questions stop whining and work on the essay questions. After you finish the essay questions work on the bonus question and then maybe you can think about whining less. If you can answer these test questions you will have increased your litigation IQ and may now have a better idea of who not to vote for in the coming Presidential and Congressional elections.
1. Did you vote for President Bush these last two Presidential elections?
Essay Question: If yes, describe why you were wrong.
2. Did you vote for tort reform or tort reformers?
Essay Question: If yes, describe why you were wrong.
3. If you work in the medical field or insurance industry answer this question: In the past seven years when someone whined about lawyers did you fail to support the civil trial lawyers or an injured person's right to sue for damages?
Essay Question: If you have not defended those trying to protect you from unscrupulous business practices (hint-hint) then describe why you were and are wrong?
4. Essay Question: Without raising your litigation IQ you may never be able to answer this one. Name five positive things about trial lawyers and the civil justice system?
5. Bonus Question: Name the plaintiff in the McDonald's case, the temperature of the hot coffee being served and why the jury verdict was correct and should not have been reduced by the Court?
