Is Direct To Consumer Marketing by Big Pharma Backfiring?

I’ve covered direct marketing to patients by the pharmaceutical industry in a previous post. I was critical that other countries don’t allow marketing directly to patients and that by doing so it creates a market influenced by patients pressuring physicians for drugs they might otherwise never take. This post on DTC ran on December 22, 2008.

Pushing drugs with DTC – Where marketing trumps science in America.

Does big business view human life as a commodity that is bought, sold and disposed of?

“Human capital wears out.”

That was a statement made to me as a lawyer by an economist. I think it does envision human life as something like a machine that does work and is depreciated over time. Life is becoming depreciated or devalued; at death you've just fully depreciated. The more we allow large businesses to run our lives the less our lives are worth.

An old college buddy forwarded some links saying as a lawyer I might enjoy watching them. Well forget the lawyer part, as a parent, husband and grandfather I appreciate the message. I did watch them and then began to wonder what they say about society in general. Watch these videos and ask yourself if this makes sense to you and is there a groundswell or backlash occurring against the industry? I have to wonder if the American public isn’t wising up to how industry research is manipulated to filter out the adverse results, all for the sake of that billion dollar per year drug.

Making a Killing

http://www.cchr.org/#/videos/making-a-killing-introduction

Prescription For Violence

http://www.cchr.org/#/videos/prescription-for-violence

Where The Truth Lies

http://www.cchr.org/#/videos/where-the-truth-lies

One has to wonder, is there a groundswell surging against prescription drugs being over prescribed through things like testing that is manipulated by dishonest doctors taking cash to act as Big Pharma’s cheerleaders?

You be the judge.

Originally posted at InjuryBoard by Steve Lombardi

Implant Safety: How to use the Internet to help monitor your health

MAINTAINING VIGILANCE AS A PATIENT – IMPLANT RECALL SAFETY NEWS

Yesterday we discussed the FDA recall classifications and today I promised to explain one method of how patients with implants can be one step closer to being safe from product defects.

MAKING THE INTERNET WORK FOR YOU

If you can breathe then you know what Google is. If you don’t know what I’m talking about then ask your son, daughter, grandson or granddaughter. It’s a great way to bond.

GOOGLE ALERTS

Have you ever used Google Alerts? Many of you probably don’t even know what these are and how you can use them. If you have any kind of medical device implanted then email and a Google Alert could be your best friend.

EMAIL IS A MUST

Do you have an email account? To use this method you will need to have email and be familiar with how to use the Internet. Assuming you use email let’s talk about having alerts sent right to your email mail box; alerts you design that search the entire Internet for specific information. You can use AOL, Hotmail or any of the other available browsers.

WHAT IS A GOOGLE ALERT?

Google Alert is an Internet search tool created by the Google Internet Company. To get to the Google Alert page do a general search for “Google Alert” using the Windows Internet Explorer. The search choices will look something like this.

1. Google Alerts

Google Alerts are email updates of the latest relevant Google results (web, news, etc.) based on your choice of query or topic. ...
www.google.com/alerts - 6k - Cached - Similar pages -

2. More Google Products

Alerts Get email updates on the topics of your choice ... Add news, games and more to the Google homepage ... Get Google products on your mobile phone ...
www.google.com/options/ - 29k - Cached - Similar pages -

3. Google Alert - Professional Web Alerts

Monitors professional interests online. Tracks the web for topics and sends new Google results by daily email. Not affiliated with Google.

SETTING UP AN ALERT THAT YOU DESIGN

Now choose the first one by either clicking right on it or put the cursor over the blue letters, right click and then select “Open in a new tab.”. A new window will open and you will be presented with a page that looks like this.

Google will more than likely ask you to first register and as you can see I already have registered using my AOL account.

What this will do is deliver to your email box any information that Google runs across about the medical product that is critical to your health and well being.

Using Google Alerts is one way you can try to stay on top of monitoring FDA Alerts that affect your health. Medical devices aren’t all that you can monitor. You can set up alerts for just about anything. Use alerts to monitor the news concerning drugs you take, procedures you’re about to undergo, a surgeon who will operate, yours child’s school and any other news that relevant to your lifestyle.

We at the InjuryBoard wish you well and encourage you to ask questions whenever you find it helpful.

Food Safety: Melamine news, including the CCP takes action against government officials for melamine contamination debacle

I’m surprised and elated of the action being taken by the Chinese Communist Party against government officials who were in some way involved with allowing the melamine scandal to develop without discovering or stopping it. As is widely known hundreds of thousands of Chinese babies suffered kidney damage and several infants died as a result of melamine contamination in infant formula. Punishing those government officials is a first step towards necessary reforms. A second pillar of a truly free society and one that the rest of the free world can do business with would be freedom of speech.

Another development in the world having to do with melamine is a new test kit for detecting melamine contamination. EnviroLogix, Inc. has developed and is selling a five-minute test for detecting melamine contamination in raw materials used in animal feed and pet food products.

"We developed this rapid test in response to industry need for a more effective way to triage raw materials being delivered to the feed plant -- and before those materials enter the manufacturing process," said Simon Varney, product manager for the EnviroLogix line of agricultural test kits. "This melamine test enables feed processors and others to ensure the quality of their ingredients and to provide buyers with confidence in finished products."

EnviroLogix is based in Portland, Maine (Hooray Hooray! It’s American made!) and is a provider of rapid diagnostics for agriculture, horticulture and environmental applications. The QuickTox Kit for Melamine, Catalog # AS 073 BG, includes 50 test strips and all the accessories needed.

Ten people convicted in the melamine scandal have appealed. Some, but not all lawsuits for compensation have been allowed. One hundred and fifty-two lawsuits have been filed. There were approximately 300,000 sick infants. Ninety-five percent of those families whose infant child became ill accepted a mere pittance in settlement of their claims. A few brave families held out for some hope that Chinese courts would accept their civil lawsuits. At least 600 families have been brave enough to not accept government settlements. What the Chinese court system is and what the U.S. court system is becoming are in opposite directions. The U.S. is becoming a socialist system that doesn’t compensate people for non-economic damages; the Chinese system is becoming more compassionate although it is far from being compassionate towards its own people. The company with the most involvement in the melamine scandal filed for bankruptcy and then was sold for 617 million Yuan or $90 million US. That company is Beijing Sanyuan Group Co Ltd.

I applaud Zhao Lianhai of Beijing a leader of these proud and brave parents. His work on behalf of these injured children and families should put him in the running for the Nobel Peace Prize. Onward you march Zhao.

“The auction came weeks after Tian Wenhua, the former Sanlu chairwoman, was jailed for life and fined $3.6 million for her role in the scandal.

At least six toddlers died and nearly 300,000 fell ill with kidney stones after drinking melamine-tainted formula, the latest in a series of health scares to batter the "made in China" brand.

Beijing Sanyuan Group, parent company of Shanghai-listed Beijing Sanyuan Foods Co (600429.SS), made the joint bid with its subsidiary, Hebei Sanyuan Foods Co Ltd. ($=6.84 yuan) (Reporting by Michael Wei; Editing by Nick Macfie)”

In other news China launched a nationwide study of the melamine kids.

Read more about melamine and how this contamination of the food supply has affected the world economy and the good people of China.

Food Safety: Melamine contamination accusations against America's Wyeth found to be false

Wyeth’s baby formula made in or imported into China has been determined by consistent and independent testing to be safe from melamine.

“China's quality watchdog tested every batch of milk powder produced and imported by Wyeth since Sept. 14 and found no problems, the official Xinhua News Agency reported.

The tests came after a group of about 20 families said their children developed kidney stones after drinking Wyeth milk, which had been deemed safe in the height of the crisis late last year.

Madison, N.J.-based Wyeth has dismissed claims that its products are unsafe. It said its formula has been repeatedly tested and found safe by an independent lab as well as by the governments of China and five other countries in the region.”

Food Safety: Melamine contamination accusations against America's Wyeth

Wyeth, an American company manufacturing baby formula, is accused by a Chinese consumer of melamine contamination. Wyeth has tested and denies any contamination with melamine. A consumer surnamed Li has provided a list of 19 Chinese babies who are claimed to have kidney stones.

What are the possibilities with this claim?

1. There is melamine in the formula and it was introduced during the manufacturing process. This is highly unlikely.

2. There is melamine in the formula, but it was added after the consumer purchase. The baby’s do have kidney stones but not from melamine in any of Wyeth’s formula. They drank formula manufactured from Sanlu. Wyeth is now being targeted because these parents know they can’t get compensation from the Chinese manufacturer and help in the Chinese Courts.

3. There are no kidney stones or melamine in the children’s formula.

So what do would we want to see? We want to see the formula for Wyeth to examine it and determine if it was manufactured in their plants. To determine if in fact there is melamine in the formula. And the babies examined by a physician of Wyeth’s choosing. And finally produce the parents for questioning.

The last request would be free speech in China; freedom to criticize the Chinese Communist Party and government officials. Along with an investigation into the officials that looked the other way when melamine was added by Chinese milk producers. Without that America will never believe this claim against Wyeth. It looks more like simple retaliation by the CCP or desperation by the parents who need more than a mere $12,500 US in compensation to care for their sickened babies.

The Chinese government would be wise to closely investigate this claim.

Originally posted at InjuryBoard by Steve Lombardi

Food Safety: New salmonella poison test developed at Iowa State University

A new Salmonella detection test developed at Iowa State University can shorten the time to detect salmonella. Using a tape like paper to pull bacteria from the food source, then a soapy, salty water mixture is applied to the tape and in two hours an ultraviolet light source will cause the salmonella will give off a green-fluorescent glow.

It’s quick and easy.

Researcher Byron Brehm-Stecher and Bleda Bisha developed the test through the college of Food Science and Nutrition. For more information contact contact Byron Brehm-Stecher, Food Science and Human Nutrition, (515) 294-6469, byron@iastate.edu or Dan Kuester, News Service, (515) 294-0704, kuester@iastate.edu.

Brehm-Stecher's and Bisha's findings will be published in the journal Applied and Environmental Microbiology, published by the American Society of Microbiology.

Once at a location where an outbreak of salmonella has occurred, investigators can test the produce for contamination. Outbreaks can be due to other factors such as food preparation.

Once investigators find the origin of the salmonella, they can take steps to contain it, said Brehm-Stecher.

Salmonella can be found on produce such as tomatoes, cilantro, peppers, spinach and others. The produce can be contaminated while it is in the fields or during processing. Washing the produce thoroughly can help, but cannot ensure the produce will be safe.

The tape-FISH technique can also be used to test produce that is not suspected of being contaminated, but the volume of produce that would need to be tested may make this impractical. However, the technique could be very valuable as a basic research tool. Researchers could investigate how salmonella and other types of organisms interact on produce surfaces, said Brehm-Stecher.

This is the first application of tape-FISH to salmonella, but the idea came to the ISU researcher while reading about art restoration.

In 2008, Brehm-Stecher read about an Italian group that was using a similar approach to look for bacteria on ancient catacombs. Those researchers were hoping to identify and remove bacteria that were slowly eating away at the relics.

For more information contact contact Byron Brehm-Stecher, Food Science and Human Nutrition, (515) 294-6469, byron@iastate.edu or Dan Kuester, News Service, (515) 294-0704, kuester@iastate.edu.
Originally posted at InjuryBoard by Steve Lombardi

Lately, America’s largest imported product seems to be communism

As an American, if you don't believe in some form of regulating imported products then you're a communist. If as an American you don't think the people of China need freedom of speech then you are a communist.

The melamine contaminated baby milk from China is into its next phase. Lawsuits were filed in the Supreme People’s Court Of the People's Republic of China (An oxymoron I'd say.) in Beijing for the 213 children, including 4 that died, to obtain monetary compensation from Sanlu. There is just one hitch, the Supreme People’s Court has already rejected several similar lawsuits and has the power to accept or reject class action lawsuits. Since this is a politically sensitive subject, (Oops you mean Communist Party Officials may have been involved with corruption?) it’s not likely the CCP is going to allow a public airing of official corruption. So expect this lawsuit or lawsuits to be dismissed like all the other ones. The lawyers are hoping this one, when dismissed, at least garners an explanation of why they are being dismissed. Don't hold your breath waiting for that written decision.

When the news doesn’t fit into the CCP’s idea of what they want the Chinese people to believe the CCP simply lies or as you will see uses outright intimidation and files criminal charges for having possession of state secrets, fraud or espionage. It’s not unusual for the CCP news to conflict with reality. It appears that the truth or facts that expose the truth are state secrets.

http://www.youtube.com/watch?v=AjAh20xatjM

By now you should know that the chemical melamine found in infant formula is used to make tires or tables or dishes. But as we now know it was being used to do an end run on protein testing of milk watered down to increase profits. The CCP is up to it's eyeballs into covering up the official corruption involving the who concerning melamine contamination in milk.

http://www.youtube.com/watch?v=prLr1PNCeSg

Lying by the CCP isn’t new. Recent lies have included the sovereignty of Tibet and the treatment of Tibetan monks. Tibetan monks in March 2008 provided evidence of recent attempts by the Chinese Communist Party officials to impersonate Tibetan monks in Lhasa for the purpose of distorting the news the outside world would hear about Tibet. Risking their safety and lives real Tibetan monks stormed the phony news conference and told the truth about lacking freedom of speech and the truth about the Tibetan people’s treatment at the hands of the CCP. The Chinese government quickly took the monks away. See it for yourself in this March 31, 2008 YouTube video clip.

http://www.youtube.com/watch?v=pnIqn9yj7s4

Globalization requires honesty by governments of country’s that manufacture products for export. Otherwise those countries that are importing their products live according to the export country’s standard of government. If the United States, as an importer of defective Chinese goods doesn’t regulate safety, then we allow the Communist government and the Chinese Constitution to be substituted for the United States Constitution. In other words, the lack of the freedom of speech in China is what we import along with melamine laced food products.

America elects government officials, and its citizens have the right to criticize those citizens when corruption occurs. But that’s not the case in China. In China if you criticize government officials you end up in prison.

When our own government turns a blind eye to regulating Chinese imports our elected officials capitulate to the Communist Constitution and the Communist form of government. We are a democracy not a communist form of government.

If you want to see Chinese police intimidate common citizens look at this video. Watch at 1:18 minutes into the interview. It’s striking how the police move in to check “papers” and take the witness away for more of the same.

http://www.youtube.com/watch?v=W1_vc2ZQI5w

The CCP even jails news reporters who tell the truth.

http://www.youtube.com/watch?v=Z-O5edpUVN0

Like it or not we are living according to a standard that is determined by what U.S. elected officials and Chinese Communist Party Officials do or don’t do with regulating Chinese exports being imported to the United States. The problem is too big for the CCP to guarantee export product safety. As an example companies caught in the melamine scandal simply closed shop and disappeared from the landscape. How do you regulate a here-today-gone-tomorrow industry? Believe it or not the lack of freedom of speech in China affects our safety. If we don’t care about freedom of speech in China for the sake of its people we should care about it from the standpoint of imported product safety. The best regulatory reform we can enact is exporting freedom of speech for the Chinese people. By the CCP allowing the dissidents to speak out about official corruption they will convince America they are serious about export safety.

How do we effectively protect ourselves and regulate imports from China? Let freedom of speech ring out across China.
Originally posted at InjuryBoard by Steve Lombardi

Food Safety: Melamine test looks promising.

The chemists at ETH Zurich (Renato Zenobi, Huanwen Chen, and colleagues) have developed a new mass spectrometric analysis method with which polluted milk can be detected reliably within 30 seconds.

Here is what they say about the test’s advantages over what currently is done to test for melamine.

”Explaining the advantages, Zenobi says, “Using ultrasound-assisted EESI-MS, we can analyse milk directly without any sample preparation steps. The method is fast and very accurate, and needs no more than one drop of milk.” Previously, an analysis required between twenty and sixty minutes to determine the concentration of melamine in a milk sample using standard methods. Zenobi’s group can do it in just 30 seconds. The current publication describes the analysis of milk, milk powder and wheat gluten, but, according to Zenobi, EESI-MS can, in principle, be used to determine the level of melamine in any foodstuff. The detection limit is 500 ppb (parts per billion) – which is five times less than the limit value allowed in foods in the USA and EU.”

Graham Cooks from Purdue University for another method of testing. This seems to be the test with the most promise in terms of ease and quickness. I'll try to cover the R. Graham Cooks test in a later post.

”Portable EESI-MS for on-site analyses

A comparable analysis method for melamine was published in the same issue of “Chemical Communications” by one of Zenobi’s colleagues - R. Graham Cooks from Purdue University, USA. However, Cooks atomises and ionises his milk sample by bombarding it with a charged gas (low-temperature plasma; LTP). Zenobi is happy to say that, “Both methods are accurate, fast and robust. Our results are practically identical; the fact that they now appear in the same journal is an amusing coincidence. I really knew nothing of Graham’s melamine project until a short time ago.” At present, the chemist is unwilling to speculate as to whether one of the methods will ultimately become established, and if so, which one. In principle, both methods can be used by any laboratory equipped with an electrospray MS without significant additional expense. Nevertheless, Zenobi is not overly confident that the methods will gain immediate acceptance in foodstuffs testing laboratories: “Established methods usually persist for a very long time – it is hard for innovations to gain a foothold.”

His group is currently working to develop the method further for use in the field. The scientists have in mind a portable instrument that could be used to measure the melamine content directly when the milk is being processed, for example during bottling. Explaining the essential advantage of such an analysis instrument, Zenobi says, “The shorter analysis time is one thing, but the majority of the time - and therefore money - is lost during all the logistics connected with taking the sample.” He is still to receive a direct enquiry from China regarding application of the technology. However, easy-to-handle analysis instruments based on EESI-MS technology might one day contribute to preventing a food scandal such as the one in China at an early stage.”

Make Your Super Bowl Party "Too Hot to Handle"

It’s here – GAME DAY! Put on your jerseys and your drinking shoes, the Super Bowl is upon us. But wait, do both with a bit of caution…

Yesterday we went over some of the health hazards the buffet-style eating so common at Super Bowl get-togethers can pose. Today, how to lessen those risks when preparing food at a home-based party.

As highlighted yesterday, food-borne illnesses are the greatest threat to such family-style events. Dishes that are left opened and exposed for prolonged periods of time are at great risk for contracting one of the many strains of bacteria known to cause such illnesses.

There are, however, numerous ways to lessen these risks. For starters, be smart about the handling of food. Wash your hands before, during and after the preparation of each dish and make sure all dishes and utensils are clean as well. Many people don’t think twice about using a knife to cut raw meat, rinsing it, then using it to open a package of cheese or chop up crudités as well. Unfortunately, however, even the slightest contact can spread the unwanted bacteria that may have been present in the meat juices, contaminating the food and putting party guests at risk for illness.

One way to kill such bacteria is to cook foods at the proper temperature. Chicken wings and/or tenders are a hot commodity at game-day events; but make sure they actually are “hot.” When cooking the first time, poultry should reach an internal temperature of 165 degrees F (beef cuts should be cooked to 145 degrees; ground beef and pork to 160 degrees). If you’re not serving fresh out of the oven, divide the food into several small, shallow containers so that it cools evenly when you refrigerate. Also important is the temperature of your fridge: it should be set at 40 degrees F (as this is deemed the safest in terms of keeping bacteria in check.

When you’re ready to eat, microwave until hot (warm just won’t cut it, for purposes or taste and safety). Serve promptly and never let food sit out for more than two hours as it presents an open opportunity for bacteria to thrive.

Follow these simple steps and you’re bound to have a butt-kicking Super Bowl party with good, safe eats.

But don't stop the safety train there. Many of you are bound to have massive amounts of leftovers, which is fine. But be smart about how you store and reheat. I was raised in a house where “we don’t waste food” but I’m smart enough to know that sometimes it’s better wasted than consumed. If you question the safety of a dish, toss it. But if you’re confident the food is uncontaminated, store it properly, consume within a reasonable time frame and enjoy!

Originally posted at InjuryBoard by Megan Roth

Diet Safety: Trimming the fat with Dexatrim

Maybe I'm just noticing them more because I've been researching and writing about them, but I feel like diet supplements are everywhere. Legitimately, everywhere.

I was walking home from work last night and noticed a “40% of all diet pills” sign in the window of a bodega. An hour later I was reading Fitness Magazine while I worked out and came across a Tonalin ad. Then again this morning I was watching the news and lo-and-behold, a Dexatrim commercial came on.

Like I said, everywhere. Then it struck me; I realized this is one diet supplement that is advertised like crazy (and almost everyone has heard of), yet, I don’t know much about it.

Dexatrim – a supplement that is offered in several different formulas, each of which delivers non-stimulating appetite suppression.

And though it may seem the diversity amongst those products results from a dedication towards meeting the needs of each and every customer, such isn’t necessarily the case.

Dexatrim has traveled a rocky path these last few years. In 2001, Dexatrim products were recalled after it was discovered that they contain phenylpropanolamine (PPA) (which is also used as a relief aid for nasal congestion and allergy symptoms). Why the recall? FDA officials seem to have recognized the strong correlation between PPA consumption and increased risks of stroke.

And again in 2002, certain Dexatrim products were recalled when the FDA banned ephedra (again for its correlation for increased risks of stroke and heart attacks).

Two recalls in two years? Scary thought. So is it safe to take today? Unfortunately, that’s tough to know. Dexatrim manufacturers claim the supplement is safe and effective; however, the FDA has not validated any such claims.

In addition, many are skeptical when it comes to Bitter Orange (one of Dexatrim’s ingredients), which is under ongoing investigation and is thought to affect users in ways similar to ephedra.

And for Dexatrim consumers, those effects are relatively well known. Most common symptoms include increased heart rate / blood pressure, nose bleeds, headaches and restlessness / difficulty sleeping (among several others.

The risks of experiencing Dexatrim side effects increase drastically when used in conjunction with other medications (expecially MAOI inbibitors). Using Dexatrim while on MAOI inhibitors (such as Prozac) are highlighted for increasing the odds of depression; however, don’t think you’re safe if you aren’t on prescription meds. Even something as simple as ibuprofen could increase the risks of the aforementioned side effects, as well as upping one’s odds for depression.

I know I’ve said it with all of the previous diet pills I’ve reviewed, but I feel Dexatrim especially should be taken with caution (in fact, I’d say it shouldn’t be taken at all, but consumers will do as they please); so do your research. Know what ingredients are in the Dexatrim pill you’re taking. Know the potential side effects of those ingredients and how they interact with other meds (prescription and OTC alike).

You really can’t be too cautious considering the diet aids potential to have both long and short-term effects on your health. If you have experienced any such effects, contact the Lombardi Law Firm for assistance.

Originally posted at InjuryBoard by Megan Roth
