      <title>Coal Train Coming, 19-year-old driver sits on tracks</title>
      <description>&lt;p&gt;Was the death of Brianna Culp, the 19 year old who was hit by a coal train, a suicide? That is the question police are asking as they look into the accident that happened Sunday, October 11&lt;sup&gt;th&lt;/sup&gt; 2009. Miss Culp was a sophomore at Wesleyan College in Mount Pleasant and the &lt;a href="http://www.kcci.com/news/21280463/detail.html"&gt;BNSF spokesman Steve Forsberg said that they crew on the 135-car train reported the woman was sitting on the tracks and didn&amp;rsquo;t try to get out of the way.&lt;/a&gt; Police are waiting on autopsy results to help determine what caused the tragic death of this young lady.&lt;/p&gt;

      <title>Negligence, failing to yield, other driver and passenger deaths. Who's at fault?</title>
      <description>&lt;p&gt;On October 8&lt;sup&gt;th&lt;/sup&gt; 2009 a Ford Tempo was heading westbound on 63&lt;sup&gt;rd&lt;/sup&gt; St. when the driver failed to yield at the stop sign at the intersection of 19&lt;sup&gt;th&lt;/sup&gt; Avenue and collided with a Chevrolet Suburban driven by Jennifer Engler. The name of the driver of the Ford Tempo is not being released at this time however the two passengers in the vehicle, &lt;a href="http://www.vintoneagle.com/article.php?article=1038"&gt;Paul Steven Lauritson and Stephanie Ann Dripps&lt;/a&gt;, died as a result of injuries suffered in the crash. Jennifer Engler and two other unnamed passengers in the Suburban were injured and taken to area hospitals no other information is available at this time.&lt;/p&gt;
&lt;p&gt;Answering &amp;ldquo;&lt;em&gt;why&lt;/em&gt;?&amp;rdquo; most always goes back to speed, control, paying attention and distractions along with the number one cause OWI. We don&amp;rsquo;t have a lot of details about this crash/wreck but chances are it will fall under one of these causes. The driver of the Chevrolet Suburban and all the passengers will have a cause of action against the driver. The main question being was he &amp;ldquo;negligent&amp;rdquo;, or in Iowa we now say &amp;ldquo;at fault&amp;rdquo;, which is simply a lay person&amp;rsquo;s way of saying negligence. The Uniform Jury Instructions in Iowa have gotten very user friendly. To make people friendlier to it, the courts have tried to demystify the language it uses when coming into contact with the public. Is it working? Hardly, it&amp;rsquo;s adding another layer of confusion to what we lawyers have to do in this still noble profession. I for one am tired of trying to do what McDonald&amp;rsquo;s did for the fast food industry. Dumbing down the court system for a generation who grew up on participation trophies is not my idea of streamlining the legal system.&lt;/p&gt;

      <title>I-35 Texas Car Accident Involves a Cyclone and a Hawkeye Football Player</title>
      <description>&lt;p&gt;&lt;a href="http://www.purcellregister.com/articles/2009/11/25/news/doc4b0c64383a2c7732818491.txt"&gt;David Cato&lt;/a&gt;, 19 who plays defensive back for the Iowa Hawkeyes and &lt;a href="http://www.purcellregister.com/articles/2009/11/25/news/doc4b0c64383a2c7732818491.txt"&gt;Ter&amp;rsquo;ran Denton&lt;/a&gt;, (sic) 19 a defensive back from the Iowa State Cyclones were driving on I-35 south of Purcell at 10:00 a.m. on a Sunday when the car they were in rolled after coming in contact with a semi-truck. According to the news report the trooper has the 18-wheeler being nudged before rolling and striking the embankment on the west side of the Interstate Highway.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Both Cato and Denton were wearing seatbelts. Both required medical care and treatment. It appears the most seriously injured was Denton, the Iowa State Cyclone, who was transported to the Norman Regional Hospital for a head injury. There is no indication if he suffered from traumatic brain injury or how serious and extensive his head injury.&lt;/p&gt;

&lt;p&gt;David Cato is listed on the &lt;a href="http://iowa.rivals.com/croster.asp"&gt;Iowa Hawkeye Football team roster&lt;/a&gt; as a sophomore defensive back from Arlington, Texas. He is listed as second on the depth chart behind Sash.&lt;/p&gt;

      <title>Motorcycles Also Have the Right to Assume Car Drivers will obey the Rules</title>
      <description>&lt;p&gt;On October 18&lt;sup&gt;th&lt;/sup&gt; 2009 at around 11:50 p.m. Ryan Thomas Brooks was eastbound on Southwest Army Post Road when his motorcycle collided with the Dodge Charger driven by Ramonte Davis. Mr. Davis is said to have &lt;a href="http://www.desmoinesregister.com/article/20091019/NEWS/91019001/1001/"&gt;pulled onto Southwest Army Post Road to back into a parking spot when Mr. Brooks crashed into the front fender of the Dodge&lt;/a&gt;. Mr. Brooks was pronounced dead at the scene and police believe that speed was a factor in the accident and have said that Mr. Brooks was wearing a helmet.&lt;/p&gt;
&lt;p&gt;Not seeing motorcycles is an often given excuse for having caused a crash with one. A proper lookout is a lookout that looks not just for the obvious, but also the less than obvious drivers, like motorcycles. As a driver you aren&amp;rsquo;t responsible for just what you saw, but for what was obviously there or that you can anticipate can be there and is lawfully using the city streets and roadways. In this instance the driver of the car is most likely the at-fault driver and can be held liable to the estate and dependents. Before backing up look, look hard and look for motorcycles. They too have the right to use the roads and to assume other drivers will obey the laws in Iowa.&lt;/p&gt;

      <title>Man killed in plant explosion, sparks or static electricity?</title>
      <description>&lt;p&gt;In Columbia County, Wisconsin a 47 year old man died Sunday October 18&lt;sup&gt;th&lt;/sup&gt;, in an explosion in the American Packaging Corporation plant, according to the &lt;a href="http://host.madison.com/wsj/news/local/crime_and_courts/article_95f53d38-bca3-11de-a2b9-001cc4c03286.html"&gt;Wisconsin State Journal&lt;/a&gt; news source. Jeffrey Doxtator was from Columbus and had worked at the plant for 13 years. Fire Chief Randy Koehn said that Doxtator was &lt;strong&gt;using a handheld grinder which ignited sparks &lt;/strong&gt;in an &lt;strong&gt;area of the plant designated hazardous&lt;/strong&gt;. This employee &lt;em&gt;error&lt;/em&gt; is thought to have caused the explosion and not the lack of safety precautions by the company. The Wisconsin plant has had good safety history according to electronic federal safety records.&lt;/p&gt;
&lt;p&gt;At the time of the blast, 6pm, the only other workers in the building were the maintenance and janitorial crew, which evacuated the building. Doxtator, still in the building, was rescued by the firefighters and brought to Columbus Community Hospital. The coroner indicated Doxtator&amp;rsquo;s death to be from &amp;ldquo;multiple internal injuries due to blunt force trauma from the explosion.&amp;rdquo; The cost of the explosion to the building is estimated at $1.2 million.&lt;/p&gt;
&lt;p&gt;American Packaging Corporation is privately held and has three plant locations: Columbia County, Wisconsin; Story City, Iowa; and the headquarters in Rochester, N.Y. The corporation produces specialty packaging for consumer goods.&lt;/p&gt;
&lt;p&gt;At the time this blog was written the investigation of the Sunday explosion was still underway.&lt;/p&gt;
&lt;p&gt;I'm not sure the error can be said to be that of the employee. That conclusion was stated as a fact at a time when no investigation had taken place. It would be important to know what actually caused the explosion: the tool being used may have had no effect on causing an explosion. Also I'd want to know who provided the tools, who selected the tools, what warnings were given about using tools in this area of the plant, whether it had been done previously without incident and with management's knowledge, the exact location and makeup of this department along with a whole host of other issues to be explored. I just don't agree with the conclusion reached by the news paper reporter or whoever decided what the cause of the explosion. There is more to it than a cursory examination would show.&lt;/p&gt;

      <title>Go-Carting Safety and Riding on the Public Streets</title>
      <description>&lt;p&gt;On September 04&lt;sup&gt;th&lt;/sup&gt; 2009 14-year-old William Beaulieau and a class mate 15-year-old Jacob Murray were go-carting when the go-cart they were riding in collided with a Ford truck driven by Chad Stange. The accident occurred at the intersection of 300&lt;sup&gt;th&lt;/sup&gt; Street and Stanley Road near Fredericksburg at about 5 p.m. Mr. Beaulieau was &lt;a href="http://www.wcfcourier.com/articles/2009/09/05/news/breaking_news/doc4aa248415826d873313641.txt"&gt;driving the go cart&lt;/a&gt; and both boys were ejected on impact and both died as a result of the injuries sustained in the crash.&lt;/p&gt;
&lt;p&gt;First of all the report isn't clear but appears to say they were driving the go-cart on the public&amp;rsquo;s right-of-way; the road or street. If so, our first thought is to ask what are they doing riding on the street? And why at 5:00 p.m. when commuter traffic is likely to be increased due to people coming home from work? No license, no registration, no tags and no reason to be there. Was there a moped type flag on the go-cart? Go-carts are too low to be seen by normal drivers, so it's an accident waiting to happen.&lt;/p&gt;
&lt;p&gt;The next question that always comes up is about supervision. Where were the adults who should be supervising them and why did they think it permissible to be driving a motorized go-cart on the public streets? What were they taught about riding it on the streets? Was someone home watching Oprah when they should have watching the kids? These are the types of questions that would need to be answered.&lt;/p&gt;
&lt;p&gt;I've got experience with this in my neighborhood. I see my neighbor's children and adult children running an unlicensed ATV on the streets while trying to pull wheelies. When I see them out there my first thoughts are when the accident is going happen; you know the one that is inevitable. You see I live on a corner and I know my neighbors driving habits; probably too well. Here is my one neighbor who is also a lawyer and he drives way too fast through that intersection and now we are adding kids and young adults on an unlicensed vehicle. And then there are the neighborhood teen drivers going through that intersection as if they owned it. I&amp;rsquo;m shaking my head as I ponder the sound of metal to metal as the crash unfolds in my head; that's what happens to aging personal injury lawyers; we dream of all the crashes we've had cases about. Maybe I should move to the end of the cul-de-sac; then I wouldn&amp;rsquo;t know so much about the intersection down by Lombardi&amp;rsquo;s house.&lt;/p&gt;
&lt;p&gt;These situations lead to tough questions with very unsatisfying answers.&lt;/p&gt;
&lt;p&gt;If you&amp;rsquo;ll recall we&amp;rsquo;ve discussed a similar type of accident involving an ATV running into a parked car.&lt;/p&gt;
&lt;p&gt;But it also raises another question. What was the driver of the Ford truck doing? How fast was he going? Did he have any distractions that took away from his awareness as a driver on the public roads? His actions may not excuse his negligence. Was he aware from previous occasions that this kid would be out riding his go-cart in the street? If so, was he watching out for him? Did he know the kid was there and just ignored him? Determining negligence is such a multi-faceted task with many questions about the behavior of each actor that need to be answered about whether it lived up to the reasonable man standard. In this case it&amp;rsquo;s probably too easy to just want to blame the kids on the go-cart; but our first inclinations aren&amp;rsquo;t always the fairest either.&lt;/p&gt;
&lt;p&gt;So let&amp;rsquo;s wait till we know all the facts before judging and coming to a conclusion.&lt;/p&gt;

      <title>That center line is there for a reason.</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Samantha Martin (39) died when the Iowa State Patrol officer reports a car driven by Lisa Ann Smith (44 years-of-age) &lt;a href="http://www.desmoinesregister.com/article/20091015/NEWS/91014032/1001/"&gt;crossed the center line and caused a crash&lt;/a&gt;. Martin was driving a Dodge Neon, Smith was driving a Jeep Wrangler. Martin was from East Moline, Illinois and Smith lived in Le Claire.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;What are the possible reasons for crossing the center line.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;1. Distractions. Distracted driving.&lt;/p&gt;
&lt;p&gt;2. Driving will under the influence of alcohol or drugs.&lt;/p&gt;
&lt;p&gt;3. Falling asleep.&lt;/p&gt;
&lt;p&gt;4. Diabetic reaction.&lt;/p&gt;
&lt;p&gt;5. Intending on committing suicide.&lt;/p&gt;
&lt;p&gt;6. A heart attack or medical condition that is sudden and unexpected.&lt;/p&gt;
&lt;p&gt;7. Simple confusion.&lt;/p&gt;
&lt;p&gt;8. Automobile malfunction.&lt;/p&gt;
&lt;p&gt;9. Old age.&lt;/p&gt;
&lt;p&gt;10. Youthful exuberance.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Perhaps in this case we will never know the reason or reasons.&lt;/p&gt;

      <title>Tort Reform Begins at Home with Maintenance</title>
      <description>&lt;p&gt;According to the Cedar Rapids Fire Department the fire started on October 8&lt;sup&gt;th&lt;/sup&gt; 2009 was started by a 3 year old boy playing with matches or a lighter. What&amp;rsquo;s still unclear is how a 3-year-old obtained the matches or lighter. Another question all parents should ask is why the batteries had not been replaced in the smoke detectors making them operational. When was the last time you tested the detectors in your house?&lt;/p&gt;
&lt;p&gt;Here is the link to the story. &lt;a href="http://www.desmoinesregister.com/article/20091010/NEWS/91010006/1001/"&gt;One-year-old Diarrana Lockett who was severely injured in the fire&lt;/a&gt; has since had her condition improve, but further details beyond that are still unavailable. Firefighters had originally responded to the townhouse at 3000 J Street S.W. around 4:33 p.m. Thursday and found the girl on the second floor next to a mattress. Her grandmother, Lesia Funchess had put the young girl to bed at about 3 p.m., sometime after that her grandson had gone upstairs then came back down reporting that there was a problem upstairs.&lt;/p&gt;
&lt;p&gt;The grandmother and an unidentified neighbor tried to put the fire out, but were unsuccessful in their attempts. The fire department believes that the fire was started on the mattress.&lt;/p&gt;
&lt;p&gt;Part of child-proofing a home is &lt;strong&gt;removing temptation&lt;/strong&gt;. Another part is &lt;strong&gt;checking batteries in smoke detectors&lt;/strong&gt;. Children have a natural curiosity that at times leads to danger. This appears to be one of those situations. House fires like this one should be a warning or an example for other families to get busy checking batteries and the location of matches and lighters. Make them inaccessible.&lt;/p&gt;

      <title>What's more dangerous, cheerleading? ... Or foolish coaches?</title>
      <description>&lt;p&gt;Is Cheerleading too dangerous? Does it need to be changed? Or does the coaching system simply need to be tweaked to provide a more safety minded mindset?&lt;/p&gt;
&lt;p&gt;A &lt;a href="http://online.wsj.com/article/SB10001424052970204518504574417392008401168.html?mod=googlenews_wsj"&gt;Wall Street Journal&lt;/a&gt; article on September 17, 2009 addressed the increasingly popular sport of cheerleading and the dangers it presents to girls across America. More news coverage of the injuries incurred by cheerleaders is causing debate on whether certain aspects of the sport should be banned or at least changed. With cheerleading being the cause of &amp;ldquo;&lt;a href="http://online.wsj.com/article/SB10001424052970204518504574417392008401168.html?mod=googlenews_wsj"&gt;65% of all female catastrophic injuries&lt;/a&gt; in high school and college&amp;hellip;according to the University of North Carolina's National Center for Catastrophic Sport Injury Research.&amp;rdquo; There is no wonder why people are upset that this high risk sport does not have the same quality of medical assistance present at all times, as with other sports such as football. To help decrease the risk factor different levels of cheerleading are taking preventive measures such as, &amp;ldquo;College teams are no longer allowed to perform three-person-high pyramids and do double flips from them. High school teams can't perform flipping basket tosses and last year, twisting dismounts were banned on basketball courts.&amp;rdquo; Some states (like Wisconsin) view cheerleading as a high risk sport and called it a &lt;a href="http://online.wsj.com/article/SB10001424052970204518504574417392008401168.html?mod=googlenews_wsj"&gt;&amp;ldquo;contact sport&amp;rdquo;&lt;/a&gt; which the Wisconsin's Supreme Court&amp;rsquo;s decision &amp;ldquo;prevents injured cheerleaders from suing their schools or teammates.&amp;rdquo;&lt;/p&gt;
&lt;p&gt;If cheerleading is such a high risk sport as to be considered a contact sport, should not the association which regulates it, make changes to protect the participants or change the way the sport is performed all together. To truly estimate the risk of cheerleading first the sport must attempt to account for all participants across the country. The Wall Street Journal says that &amp;ldquo;estimates say there are about 400,000 public high school cheerleaders, but the NCAA doesn't track participation (it's not considered a sport) and the number of cheerleaders on private teams isn't known.&amp;rdquo; The number of cheerleaders all together is hard to pinpoint, but &amp;ldquo;if you go by the consensus estimate -- that there are about 4 million cheerleaders across the country -- the activity looks about as risky as women's soccer.&amp;rdquo;&lt;/p&gt;
&lt;p&gt;What was the original purpose of cheerleading: to get the crowd&amp;rsquo;s energy up and to support and &amp;ldquo;cheer&amp;rdquo; on the team. There is no doubt that the ways of cheerleading have shifted with regular stunts in routines consisting of split jumps called the &amp;ldquo;Herkie&amp;rdquo;, flipping basket tosses, and twisting dismounts. If the stunts of cheerleading of today remain, maybe the activity should be reconsidered an organized sport, instead of just a &amp;ldquo;girly athletic activity.&amp;rdquo;&lt;/p&gt;
&lt;p&gt;There have been motions set in place to attempt in helping injured cheerleaders. &lt;a href="http://nationalcheersafety.com/"&gt;Kimberly Archie&lt;/a&gt; founded the &lt;a href="http://nationalcheersafety.com/"&gt;National Cheer Safety Foundation&lt;/a&gt; in 2008, created this program as a parent of a cheerleader who broke her arm during a practice. She hopes this program will help parents be more aware of the injuries and ultimately help reduce the risks that cheerleaders face constantly. Archie&amp;rsquo;s organization has been in the forefront of cheerleader safety issues and advocating for positive changes. She&amp;rsquo;s a positive force that has successfully resisted the headwinds pushing against change.&lt;/p&gt;
&lt;p&gt;Should this highly dangerous but popular activity be changed all together, have tighter regulations, or continue to victimize America&amp;rsquo;s young girls of today. As a parent it&amp;rsquo;s your choice to accept the status quo or push for changes that may protect your child from a life of misery. All coaches need to get on the safety band wagon for the sake of the cheerleaders. It&amp;rsquo;s a terrific sport.&lt;/p&gt;

      <title>Crashing Into A Sheriff Deputy is a Bad Night</title>
      <description>&lt;p&gt;What caused 21 year old &lt;a mce_href="http://www.kcci.com/news/21259542/detail.html" href="http://www.kcci.com/news/21259542/detail.html"&gt;Travis Scott&lt;/a&gt; to veer straight into oncoming traffic? That is the question Council Bluffs police are asking after the accident in the late hours of October 9th 2009 between Mr. Scott and Pottawattamie County Deputy Jahn Kirlin left Mr. Scott, his two passengers and the deputy injured. The accident happened on 23rd St.; the driver Travis Scott and passenger Leah Wenninghoff were in serious condition, another passenger Anthony Biggert was listed in stable condition, and the Deputy was treated for hand and arm injuries. The case remains open for investigation.&lt;/p&gt;
&lt;p&gt;This is one of those types of crashes we are seeing more and more of on the Interstate highways: I-80, I35, I235, I380 and all the other parts of Iowa's interstate highway system. As the accident causes accumulate distracted driving is the number one, two or three cause. It's got to be right behind drunken driving or speeding. Many that we see are by drivers distracted with cell phones, either because of talking or tweeting or texting. I wonder what this one was about. What was the distraction that caused this young man to run right into a police car?&lt;/p&gt;
&lt;p&gt;Yesterday as I was driving by an elementary school where parents must have been attending a school activity the function ended and we all drove off together in a line. As we turned onto the main drag, University Avenue, I got in the left lane to pass them. I passed six cars in a row and every one of the drivers was a parent with a cell phone glued to their ear. With the cell phone being held to your left ear the driver's hand creates an added blind spot by the hand and arm. You can see how the driver is required to turn their entire body to see the left side if they want to see what's coming to the left. These are all distracted drivers who can cause an accident, and injure others or kill pedestrians.&lt;/p&gt;
