Robert McNamara Jr. was killed after a car-semi-truck crash near Goldfield on Thursday, June 21. The 57-year old victim was heading eastbound in his car when he collided with a northbound semi at an intersection. McNamara was thrown from his car and pronounced dead at the scene.

James Moser of Emmetsburg was the 25-year old driver of the semi-truck. There have been no reports as to whether he sustained injuries.

Practice Pointer: It's always important for someone to get to the scene as near to the collision date as is possible and to record by video and still image the scene. The Iowa Highway Patrol conducts the investigation in most death cases in rural Iowa. The State Patrol will most likely take photographs but they are not always clear and sometimes get lost. The relatives must act to protect the interests of the dependents. Protect yourself by acting quickly to obtain qualified legal representation. Measuring skid marks for length, width and direction is equally important. Checking tread on the tires along with headlights being functional can make the difference in a case.

I investigated semi-truck accident in northern Wisconsin, wherein an Iowa man died as another semi crossed the center line. What may have sounded like a front tire blowing out were actually the side mirrors of two trucks colliding. The front tire being examined by the tire expert was the tire from the passenger side of the truck not the center lane tire or driver's side. This was uncovered by my talking to the young man from the garage that towed the trucks and removed the tires. Once these facts were corrected the insurance company paid the widow's claim.

Be cautious and be aware of your rights through qualified advice from an attorney who practices in this area. Don't be fooled by ads; ask questions of your legal representative.
